In a Wichita case that has captured national attention, a double-amputee war veteran already accused of misdemeanors against a controversial Topeka church now faces a felony charge.

The latest charge — conspiracy to commit aggravated battery — was filed by Sedgwick County prosecutors Friday afternoon. The charge accuses Army veteran Ryan Newell of engaging in a conspiracy in which firearms were obtained and put in his vehicle and taken to a place where church members were located.

Mid-morning Tuesday, detectives arrested Newell. He was backed into a parking spot outside Wichita City Hall with guns and ammunition in his SUV while five Westboro church members met inside with Wichita police officials to discuss protest-safety concerns, sources have said.

The felony charge alleges that there was a conspiracy in which Newell entered into an agreement with another person.

Newell's bond remains at $500,000. His next court appearance is set for Dec. 16.

Judge Ben Burgess said at a hearing Friday that if Newell were to post the bond, there would be a hearing to consider additional conditions for his release. One condition already set is that he have no contact with Westboro members.

The Eagle on Friday received calls from New Hampshire to Nevada from people wanting to give money to Newell's legal defense or bond.

Kim Parker, the chief deputy district attorney in Sedgwick County, noted that the case has received wide attention and "that the public's sympathies may weigh heavy."

Still, Parker said, "We decide cases based on the facts and the law. We don't decide cases based on whether we like or dislike the victim or the suspect."

Meanwhile, two people — the lawyer for Newell and a spokeswoman for Westboro — say Newell is the subject of other investigations.

Newell, 26, of Marion, has remained in the Sedgwick County Jail since Tuesday evening.

"It's obvious that Mr. Newell has a great outpouring of support, some of whom share our client's view of supporting our country," said lawyer Boyd McPherson, who along with fellow Wichita lawyer Steve Joseph is representing Newell.

"He's not interested in publicity," McPherson said of Newell. "He appreciates all the support that's being offered."

Westboro and its members have been widely condemned for protesting at soldiers' funerals nationwide. Westboro contends that soldiers are dying because God is punishing the nation for immorality.

Margie Phelps is one of the five Westboro members who protested Tuesday outside Mulvane High School and then rode in a van to Wichita City Hall, where detectives arrested Newell.

Westboro members have picketed at almost 600 soldiers' funerals in the last 5 1/2 years, Phelps said. The protests generally have taken place a half-mile to a mile from funeral locations, she said. The protesters from Westboro leave when the funerals start, she said.

At nearly all of the protests, veterans on motorcycles and their supporters have been present, she said. "They track us down and try to shut us up and do harm to us," said Phelps, 54.

"Those guys aren't going to shut us up," she said. "That can be written in stone."

On Thursday, prosecutors charged Newell with stalking, three counts of criminal use of weapons and one count of false impersonation of a law enforcement officer.

The stalking charge accuses Newell of actions targeted at Westboro members and putting them in fear for their safety. Sedgwick County sheriff's detectives arrested Newell after a sheriff's detective saw him following a Westboro van to City Hall, officials said.

The weapons charges accuse Newell of unlawfully carrying and concealing or possessing with "intent to use" an M4 rifle, .45-caliber Glock handgun and .38-caliber Smith and Wesson handgun. Besides the weapons, Newell also had more than 90 rounds of ammunition in his vehicle, sources said.

An M4 rifle is a high-powered weapon used in combat; there are variations of the rifle, according to websites.

Westboro spokeswoman Shirley Phelps-Roper said earlier Friday: "Here is what I expect to happen: This guy is going to be called a hero, he may get a parade."

People "will line up to sing his praises, to pay his legal fees and to get him a lawyer," she said. "Then he will be permitted to plead to some nothing charges."

Phelps-Roper also said, "We've had communication about a federal investigation" involving Newell. "And I don't think I ought to say any more about that."

FBI spokeswoman Bridget Patton said she could neither confirm or deny the existence of an investigation.

The Eagle has previously reported that agents with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives went to Newell's home and obtained items including firearms.

McPherson, Newell's lawyer, said, "I'm hearing that there are other investigations that are pending." He declined to elaborate.

McPherson said he is working to make sure that Newell's medical needs are met while he is in jail. McPherson said he thinks Newell has been placed in the jail clinic because of medications associated with his war injuries.

Newell lost his legs in 2008 when an improvised bomb exploded in Afghanistan. Some of his fellow soldiers died in the explosion.


I have got to say. This is fucked up on both parts. Meaning, it's a hard choice to make. I can't make one! I can't say these people are wrong because the bible tells me so! But I will say that I have sinned by saying that I want these people gone. On the other side; the man should not have stalked these idiots carrying loaded guns. I'd say that for once, the victory goes to the spoiled. I can't believe I wanted the WBC to win this one. But I am not a heartless bastard. I don't condone murder. But Jesus Christ is this something that struck my fancy. And this should be a very interesting discussion.

Having interviewed Shirley Phelps-Roper (another story here), I'm not shocked by any of this.

First off, the WBC loves IEDs, and such a thing took this poor man's legs. They've inspired violence from counter-protesters, veterans, families of deceased soldiers, and others like them before.

On top of this, the WBC are lawyers. They have a family firm. The family makes its money suing the shit out of people who mistreat them.

And they THRIVE on people speaking against them, threatening them, attacking them, doing ANYTHING that helps them get noticed and makes them throw up their hands and claim they are martyrs for Christ.

What this poor man should have done is lived the rest of his life and not given the WBC a second thought. What he was planning was wrong, but I can't help but feel for him.

Thank you, and yeah, that's my voice. Someone else edited the video. My boyfriend shot most of the footage with a FlipCam.

On a side note, a media law professor saw that pic of Shirley on the street corner on the front page of the paper and asked if she could use it in the next five editions of her textbook. Finally got a copy of it.

But back on topic, I don't wish ill on the WBC, but I don't think I would cry for them either. Sort of like Jerry Falwell. Loss of life, any life, is tragic.

I'm wondering what they will do when Fred dies, though. The WBC have argued that they picket funerals because it's worshiping the dead. I highly doubt they will leave their charismatic cult leader to be carrion for the vultures. I'm sure there are thousands waiting in the wings to wag their fingers to point out hypocrisy the second he kicks it.

I was shocked, though. Shirley was REALLY nice. When I walked up to her and her daughters as they were getting out of the van and asked her if I could ask her a few questions for the paper, she smiled and said sure, but to wait until they were set up first. As we were walking toward where their corner, I just asked her, "How's your father?" and she answered, "Oh, he's fine, thanks." I was the first person to interview them, and 15 minutes after they spoke to me they refused interviews.

She was so sweet to me that I actually spent the rest of the day meditating on the interview, wondering if history's tyrants, fascists, and dictators were just as nice if you spoke to them. Seriously... it was perspective changing.

But yeah, there's several amusing ironies/hypocrisies with them.

The main one being that they HATE America. They dance and sing "I'm Ashamed to be an American Where the Fags Can Freely Roam" in place of the lyrics to "Proud to be an American" among other songs. They cheer when American soldiers die and when tragedies befall this country's people.

BUT, they demand police protection. They sue people utilizing the justice system. Above all, they clamor behind the First Amendment, the spirit of the American dream. And on top of this, they would NEVER leave the U.S., no matter how frequently they bash it.

I think that murder is wrong, and I think that what the guy did was stupid, but I feel for him. I mean, honestly, if their van or plane crashed and all the WBC morons died as a result I would not shed a tear.

Honestly, I think there should be a way to revoke their rights as a citizen since they claim to hate the country so much.

It's gonna be pretty damn ironic when people start protesting one of the member's funeral. But that's just what they want people to do. If they were to come down here, I would not even counter-protest. They just don't exist in my physical world.

E- Well, might as well share on how I became a Baptist.

A Baptist believes, that Jesus Christ ha died on the cross as their Lord and Savior. Sure, there is fire and brimstone. But there is also the love and caring that my God provides to help you spiritually.

But how did I become one?

By getting the Ever loving shit scared out of me. Down here in GA. There is a little town called LaGrange, and they have one of the biggest Baptist churches in the world. They are also the crown in holding one of the biggest dramas that will grarantee that it will "Scare the hell out of you".

I was 16 at the time and might I say that after the whole show was over. I was amazed. I mean you see some Fucked. Up. Shit. You have girls getting shot (It's not really getting shot). A MAJOR crash scene with people's arms blown off, people dragging on their torso, etc. There is also a walk where "10 years later" you literally see naked girls walking near you asking if you want to "Fuck me silly", drugs trying to be handed out, people getting sold for slavery, etc.

It's a physical experience.
