The article

PHOENIX, Arizona (AP) -- Fetuses do not count as passengers when it comes to determining who may drive in the carpool lane, a judge has ruled.

Candace Dickinson was fined $367 for improper use of a carpool lane.

But Dickinson, pregnant when she received the ticket, contended her unborn child qualified to use the lane.

Motorists who use the lanes normally must carry at least one passenger during weekday rush hours.

Municipal Judge Dennis Freeman rejected Dickinson's argument Tuesday, applying a "common sense" definition in which an individual is someone who occupies a "separate and distinct" space in a vehicle.

"The law is meant to fill empty space in a vehicle," the judge said.

Sgt. Dave Norton stopped Dickinson's car November 8. When asked how many people were in the car, Dickinson said two, pointing to "her obvious pregnancy," the officer said.

Norton said Dickinson's theory "would require officers to carry guns, radios and pregnancy testers, and I don't think we want to go there."

So do you think her unborn child should have counted as the second passenger for the carpool lane?

I think that that's a lame excuse to get into the car pool lane, I dont think it should be counted as a second person just yet.

under those circumstances I don't see how she could claim that

it's not like she invited a friend to come along (to save on gas by not taking 2 cars) or something.

the baby is stuck inside her.... it goes where she goes... and even if it was a toddler I still wouldn't say she should be able to use the car pool lane.

A fetus isn't even a being with any rational thought until it is born and many months down the road is a newborn considered not applicable for abortion.

Lame excuse to get into a car pool lane, unless you need to get to the fricken hospital because your water is going to break.

I don't think a fetus quilifies as a passenger, and the cop is right. What about inobvious pregnancies? This was just stupid on the women's part.

I'm agreeing with everyone so far. It should be common sense that the second passenger should be a seperate person. I really doubt she thought to herself that it was ok to use the carpool lane because of her unborn child and just used it as an excuse when she got caught in the carpool lane alone.

A fetus is a Fetus...not a person...Aaaand I really cant go any deeper than what I said. Other than untill the Baby is born like everyone said...I cant see a fetus being a human being untill its born...

I do disagree with the term "fetus", but that's another topic of discussion. :p

As far as this argument...I'd say it's pretty unanimous(sp?) so far and I'm only going to add to that. I think that's a stupid excuse, and though I consider a baby to be a baby and none of that fetus stuff, her excuse...just...I dunno, even if that were legitimate, it just doesn't go with the purpose of the carpool lane.

oh, I agree with you Katana....

I only stated that it was a terrible excuse for the situation. The baby/fetus etc inside of her is definitely alive and such, but just doesn't seem reasonable to use for the carpool lane.

I wasn't challenging anybody there when I mentioned about the baby/fetus thing. I appologize for not making that clear. I was really kinda reiterating how right I think everyone is here.

How the hell did she even think that she could get away with that? I agree with everyone else here, unborn children don't count for carpool.

lol I agree with everyone. I wonder what excuses pregnant women would use if the cops let this one slide? "Sorry I killed someone, sir. I had a mood swing." *sigh* I am not trying to pick on pregnant women. All types of people will do that too. Just saying right now. And yeah, the idea of having to pregnancy test someone to give them a ticket? Geeze.
